Conditions of sponsorship

Content, Liability & Conditions of Use

As "sponsors" only Titles, Descriptions and Links to internet-sites (together: "Sponsorship-Data") are allowed that correspond with MyGreat's Conditions of Use (downloadable by clicking HERE). These Conditions of Use apply as far as no further or diverging regulations are set forth within these Conditions of Sponsorship.

Only Sponsorship-Data entered or uploaded within the application form is allowed to be displayed on the URL of sponsoring applied for. Strictly forbidden are code influencing the data processing beyond the display of the Sponsorship-Data or annoying data. MyGreat, at its sole discression, reserves the right to delete and/or change Sponsorship-Data that, from MyGreat's point of view, violates the Conditions of Use and/or Conditions of Sponsorship as set forth herein.

Sponsors are wholly responsible for the content of their Sponsorship-Data and will indemnify MyGreat for all direct or indirect losses arising from the installation of this Data.

MyGreat shall not be held responsible for any loss or damage to any property of the Sponsor or any third person before, during or after the sponsorship and in no event shall MyGreat be held responsible for any loss arising directly or indirectly from cancellation or postponement of the sponsorship, or the breakdown or unavailability of the respective MyGreat-Site, for reasons which may be in or out of the control of MyGreat or any of its servants, employees, service-providers or subcontractors out of any act or default or negligence.

If the respective owner of a picture decides, Photographs, descriptions, scores and comments on the chosen URL might become subject to change or deletion and the respective URL might therefore disappear. No Refund will be given in this case!

In no case MyGreat shall be liable for any costs or damages if for any reason it fails to electronically display Sponsorship-Data and in no event shall MyGreat be liable for direct or indirect damages or losses in excess of the amount paid by the Sponsor for the respective sponsorship.

In cases of legal responsibility in spite of the exclusion of liability stated above MyGreat is free to choose if and in which form a refund, substitution or replacement of the Sponsorship-Data to another MyGreat-Site is suitable to meet the adequate and rightful expectations of a sponsor.

Positioning

Sponsorship-Data will appear on the URL of the page where the "Suggest Link"-Button was pressed by the sponsor. The sponsor acknowledges that MyGreat does not give any guarantee or warrantee whether the specific Sponsorship-Data appears in the top position or in any other position within the Textfield 'External Links', be it the second, third or fourth position or whether it remains on any one position for the whole period of the corresponding sponsorship.

MyGreat does neither warrant nor gives any kind of guarantee that there is any content on the respective site chosen by the sponsor for his Sponsorship-Data or that any data displayed there will be of a certain quality or quantity.

Cancellation

MyGreat will not accept the cancellation of a Sponsorship application once the desired period of sponsorship has started. The agreement to sponsor MyGreat shall be irrevocable by the sponsor and at its sole discression MyGreat will agree to cancel the contract or refund any part of the payment already made.

Payments

Payments for each sponsorship shall be due in full within 14 days of the date of the submission of the corresponding Sponsorship-Data, stating the invoice-number and name of the sponsor. If payment in full is not made within 14 days of the date of submission of the corresponding Sponsorship-Data, MyGreat reserves the right to cancel the sponsorship relationship without prior notice and without further consequences for both parties.

Forbiddance of resale

In no event any sponsor is allowed to sale, rent or leave for any other reason the acuired sponsorship-place to any third entity without the prior consent of MyGreat. Any such occurence will lead to the immediate and persistent exclusion of both, sponsor and third party from all MyGreat-pages.
